1. Agreement to Terms
These Terms & Conditions ("Terms") govern your access to and use of the gigPe mobile application and website operated by Kesseki Technologies Pvt. Ltd. ("we", "us", or "our"). By creating an account or using gigPe, you agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract under applicable law to use gigPe. By using the service, you represent that you meet these requirements and that information you provide is accurate.
3. Description of Service
gigPe is a peer-to-peer platform that connects consumers seeking checkout assistance with independent providers ("Gig-Assistants") who may help apply eligible card or bank offers during supported merchant checkouts. gigPe facilitates matching, communication, payment flows, and wallet features but does not guarantee any specific merchant offer, discount amount, or transaction outcome.
4. Accounts and Security
- You are responsible for maintaining the confidentiality of your account credentials and device access.
- You must promptly notify us of unauthorized use of your account.
- We may suspend or terminate accounts that violate these Terms or pose a security or fraud risk.
5. Consumer Responsibilities
- Provide accurate deal, payment, and contact information.
- Use gigPe only for lawful personal shopping on supported merchants.
- Review order details, amounts, and payment instructions before confirming payment.
- Do not attempt to circumvent platform protections, fees, or matching rules.
6. Provider Responsibilities
- Complete identity verification (KYC) and any checks we require before receiving payouts.
- Use only payment cards and accounts you are authorized to use.
- Follow gigPe guidance during checkout handoff and deal completion.
- Do not misuse consumer information or merchant checkout sessions.
7. Payments, Wallet, and Settlements
Payments, refunds, wallet credits, and provider settlements may be processed through regulated third-party payment partners. You authorize us and our partners to process transactions needed to operate gigPe. Processing times, fees, chargebacks, and settlement rules may apply as disclosed in the app or partner terms. Final eligibility for merchant offers, refunds, or charge reversals may depend on merchants, banks, card networks, and payment partners outside our control.
8. KYC and Compliance
Providers may be required to submit identity verification documents. We may refuse, suspend, or terminate access if verification fails or if we suspect fraud, money laundering, or other unlawful activity.
9. Third-Party Merchants and Services
Merchant websites, payment gateways, banks, and other third parties have their own terms and policies. gigPe is not responsible for merchant product quality, delivery, cancellations, or third-party website availability.
10. Prohibited Conduct
You agree not to:
- violate any law or third-party rights;
- submit false, misleading, or fraudulent information;
- interfere with platform security, integrity checks, or other users;
- scrape, reverse engineer, or automate access except as permitted by law;
- use gigPe for unauthorized commercial activity, spam, or harassment.
11. Intellectual Property
gigPe, its branding, software, and content are owned by Kesseki Technologies Pvt. Ltd. or its licensors. You receive a limited, non-exclusive, non-transferable license to use the app for personal use in accordance with these Terms.
12. Disclaimers
gigPe is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchant offer availability, uninterrupted service, error-free operation, or fitness for a particular purpose.
13. Limitation of Liability
To the maximum extent permitted by law, Kesseki Technologies Pvt. Ltd. and its officers, directors, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of gigPe. Our aggregate liability for direct damages shall not exceed the greater of (a) amounts paid by you to gigPe in the three months before the claim or (b) INR 5,000, except where liability cannot be limited under applicable law.
14. Indemnity
You agree to indemnify and hold harmless Kesseki Technologies Pvt. Ltd. from claims, losses, and expenses arising from your misuse of gigPe, violation of these Terms, or infringement of third-party rights.
15. Suspension and Termination
We may suspend or terminate your access at any time for violation of these Terms, risk concerns, or legal requirements. You may stop using gigPe at any time and request account deletion as described in our Privacy Policy.
16. Governing Law and Disputes
These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction, subject to applicable consumer protection laws that may provide you additional rights in your place of residence.
17. Changes to Terms
We may modify these Terms from time to time. Updated Terms will be posted at https://gigpe.co.in/terms. Continued use after changes constitutes acceptance of the updated Terms.
